because not process "use" /dev/log !
I don't really understand you here. syslog-ng fails to open /dev/log as creating a socket is a write operation. Try ktrace-ing the original syslogd to see what it does to create its socket. Maybe it creates /var/run/log and /dev/log is a symlink to /var/run/log ?
